Well, the HOA has decided to enforce the 55 and over law
and is asking for $1,000 from 155 members in the community
to sue her to get her out of the neighborhood
because she's 28 years old, not 55 plus.
This in my opinion is despicable.
These HOAs have way too much power.

from her father, this case is drawing national attention and exposing a neighborhood divided.

Some residents say they support Bethany Mitchell. Others say enforcing the community's age restrictions
is just part of living in a 55 plus neighborhood. Consumer investigative reporter Tiffany Salome
brings us both sides of this debate. I mean is this even legal? Like you can have a 50,
like since when can you discriminate against people based on housing? Like isn't this
like illegal? Like, it's not like the HOA over rules like the Civil Rights Act.
We're back at Arbor Mill today. This is the Oakleaf neighborhood where 155
homeowners will have to pay a thousand dollar special assessment to sue their
20 each year old neighbor. That's Bethany Michelle. She inherited a home after her
father passed away and today we are hearing from some neighbors who agree with getting her out.
It's really not about this young lady. It's about enforcing the age requirements
across the board. They have the right to choose to live in an HOA and they bought into an HOA
where it's 55 and above. I mean yeah there are some younger folks like me that live in here.
Is there like I mean I'm the kind of guy where it's like if I hear something like this
I think about parallels and like can you have an all-white neighborhood? Can you do that like
theoretically right? Can you have a neighborhood where there's only white people allowed in the
neighborhood? As far as I don't know like I'm not even sure you should be able to well I mean
whenever you're having and here's the thing right is that this is a like these are these
These are houses, like they're connected to public roads, et cetera.
It's not like this is all on totally private property.
And that's fine, because I live with somebody that's over 55, and while her dad was alive,
there was no problem with the young lady living here.
But the rules are the rules, and if we don't enforce the rules for one, we can't
enforce the rules for all.

for all homeowners, all 55 plus people with caregivers.
Personally, I think she should move. I think her dad did her the great honor of
Leaving the helps to her, but I mean this is an over 55 community

That's what you have to pay an attorney to get them to represent you on a losing

There's a lot of levels of accountability that exist in the government that prevent
bad actors from taking advantage of things that they wouldn't otherwise take advantage

And fundamentally, when a person buys a house, I don't think that they should have to worry
about all these extra tacked on levels of accountability to people who are not the
government.
I dislike the concept of you being accountable to a person who, like, you make a say,
buy a house, right? And that's a contract between two individual people. This house is,
it's not a public house, but you're, you know, listing this house to the public.
There are public utilities going to this house. There are roads that are now,
you know, like basically taking care of this house. So just whenever you say it's private
property, this is private property that exists in the scope of a public world, right? And this
is a community of people and it's a country. And so you don't just get to go and make
your own rules and say it's kind of like you remember back in like the COVID era and like the
BLM days where they had chas and it was like this area of like Seattle where they said we're not
going to let any police in there and then they didn't let any police in there and somebody died
or something like that like this is kind of the same thing where you have a group of people

today, the nitty-gritty of exactly what went down in the latest filing in the
Miskiff case. So anytime you see the language that says plaintiff, just put
Miskiff's name in there. He's the guy who has brought this claim against the
plethora of people that he thinks have wronged him. Now amongst those, of
course, the prime defendant here is Emeru, who is not off the hook. But even
with emiru her chances of winning seem to be going up based on the latest
filing in what happened and of course we have the roach king over here in his
glorious rainbow shirt he was a defendant in this case but now things have
changed in his favor so what exactly happened what exactly went down well
first we need to get into this law called the ending forced arbitration
of assault and harassment.
This is, dude, this was so fucking retarded.

We're talking about legal definitions here of SA or SH.
And this was meant to keep people who signed pre-dispute arbitration agreements from being
forced into silence.
This is meant to keep victims from being essentially bullied by these agreements, which they may
have signed without really thinking about it or maybe even under duress or saying, hey,
you're not going to get this job or position or we're not going to enter into this agreement
with you unless you sign this.
So essentially this is to stop people victims from being bullied and forced into these
secretive agreements that might go down during arbitration because arbitration has its
benefits.
One of the things is it isn't as transparent.
People don't get to see what goes on in that arbitration.
So that's one of the key things here and in this case.
Yeah, and keep in mind it's meant so this law is meant to protect victims.
To protect people that are victims of bad behavior and harassment and stuff like that.
This is for victims.
to focus on and the judge specifically focuses on the fact that this was meant to keep victims
underline that victims from being forced into a secretive arbitration so what went down
this latest ruling from the judge in this case well let's look at the exact text here
and this is fascinating so they go on to say the judge says plaintiff that's misgift
claims that the word involving in an essay dispute definition is so broad as to make
the EFAA's treatment of SH and SA entirely different.
So he's trying to break those things out
for his own benefit to make his case.
However, both definitions contain broad language
involving related to, but neither sweeps so broadly
as to mean the person alleging conduct constituting
an SH dispute or SA dispute.

I.e. the person who may elect to avoid arbitration
is in fact the person accused of
or denying either SA or SH.

What this is saying is, is that the perpetrator,

he was the one that was accused of this bad behavior
and he's trying to use a law
that protects victims of the bad behavior.
That's the precedent that he was trying to use.

perpetrator and the judge did not buy that at all what so ever in fact they go
out to say that we're going to reject that argument and take up the
recommendation of the magistrate judge the magistrate judge susan what a
fucking surprise that using a law that's meant to protect victims when
you're the one who was being accused didn't work. What a fucking weasel. What a little

against Asmone Gold. So while Asmone's gold taken lose twice,
is dismissed, it is possible if there were some new facts or
something else came out or there were some by the way, like
the fact that like you like getting the ship dismissed is

and explain how each statement was defamatory how it was false and how
it harms him that's gonna be a significant hurdle for misgift and
and then Miskiff still has a chance. So I don't want to say at this point, once again,
you never know with cases. They can take wild and crazy turns. So I want to be conservative
here in my assessment saying, yes, it is possible that Miskiff could find some facts and come
against Asmongold again. It's possible he could prevail against Emeril. But at this
point, his window for Vic... It's not what I would bet on. So far. It's not what I would
bet on. Three is narrowing. It's becoming harder and harder for Miskiff. And this is
the point at which I would say to Miskiff, are you really committed to taking this
all the way or would a settlement really make you happy, bro? Would you be okay with
some form of settlement, maybe an emerald apology saying, hey, I framed this in a bad
way, it's not going to happen, shouldn't have said this this way, maybe I should have
framed this in a different way, right? Maybe it shouldn't have been my emotional truth,
maybe I should have framed this in a more objective and neutral way, maybe something
like that, a settlement, maybe a payment, who knows? Is that an option that might
be better for you or better for all parties? I would say, look, misgift your window
